Abstract

The author drew attention to the importance of the legal aspect of covering the problem of the Holodomor of 1932-1933 in Ukraine in modern domestic historiography. The purpose of this work is to cover the historical and legal aspects of the problem of the Holodomor of 1932-1933 in modern domestic historiography; study the Holodomor of 1932-1933 in Ukraine through the language of legal documents; study the tragedy of the Holodomor of 1932-1933 as a genocide against the Ukrainian people in different countries of the world. It is noted that all the actions of the then Stalinist leadership, including legal ones, in relation to the Ukrainian peasantry, which was left on the verge of extinction, are incriminated as crimes against humanity that have no statute of limitations. Based on the overall complexity, massiveness of the tragedy, and the assessment of the legal actions of the Stalinist leadership, it is proven that the Holodomor of 1932-1933 was artificial in nature and had all the signs of genocide against the Ukrainian people.
The importance of the studies of V. Vasylenko, N. Svynarenko, S.Yu. Ivanova, M.M. Antonovych and others in the study of this topic is mentioned. It is noted that the death registration books for 1932-1933 and other documentation of that time in all archives of Ukraine were inaccessible for use even by specialists, in the country of the Soviets an absolute ban on information about the famine was in effect until 1987, the Soviet authorities had something to hide from their people. The dynamics of the dissemination of information about the Holodomor of 1932-1933 in Ukraine as genocide against the Ukrainian people in the representative and legislative bodies of various states of the world are analyzed in chronological order, the years of recognition of this event as genocide are indicated.It is stated that for the history of the formation of independent Ukraine, the law «On the Holodomor of 1932-1933 in Ukraine», adopted by the Verkhovna Rada of Ukraine on November 28, 2006, which defines the events of 1932-1933 as genocide of the Ukrainian people, is of great importance.
