Legislation About State Support Of Agriculture Of Ukraine: Problems Of The Development
The article analyzes the current legislation about state support of agriculture of Ukraine. The author determines the main problems of modern legislative ensuring of state support for the agricultural sector. Conclusions on further development of the legislation about state support of agriculture of Ukraine are grounded.
The author states that the formation of a separate legal institution of state support of agriculture of Ukraine was caused by the priorities of modern state agrarian policy and objective needs of ensuring the state’s food security.
It is noted that today the main legal act of the agrarian legislation of Ukraine regulating the relations of state support for agriculture is the Law of Ukraine ‘On State Support of Agriculture of Ukraine’ dated 24 June 2004. This law determines not only the goals and tasks of state regulation of agriculture, but also contains legislative regulations aimed to support agricultural production. It defines the foundations of state policy in budget, credit, pricing, regulatory and other spheres of public administration aimed to stimulate agricultural production, agrarian market development and ensuring of food security.
It is predicted that the future development of legislation about state support of agriculture of Ukraine in terms of the European integration should be based on the principles of the Common agricultural policy which provides for a gradual reduction in direct subsidies to agricultural producers and the priority of financing the programs of rural development and environmental measures in agriculture.
The opinion about the expediency of the institutional codification of the legislation about state support of agriculture is grounded through significant renovation and expansion of the scope of the Law of Ukraine «On State Support of Agriculture of Ukraine», bringing the measures of state support of agriculture in line with the requirements of the WTO and the EU.
