Legal Construction Of Foundation From The Perspective Legislation Of Ukraine

The scientific article analyses the modern understanding of the term «foundation» in Ukraine. It is noted that the term « foundation « can not include all legal persons which are based on unitarian basis. That is why the author makes an offer of implementing the new term «non-for-profit unitarian legal person» in private law. In limit of mentioned term should function all non-for-profit legal persons which are based on unitarian basis. Public authority are foundations which are providing their activity in legal form of non-for-profit unitarian legal person. To them the author is referring: legislative and executive bodies, courts and law enforcement agencies, government agencies with special status (National Bank of Ukraine, State Property Fund of Ukraine, etc.) and others.
