Legal Description Of Insurance Risk In Contract Of Medical Insurance

Abstract

In this article the author investigates the legal nature of the category of juridical risk in aspect of its manifestation in private-law relationship. The author investigates the essence of the notion of risk, analyzing the concept of subjective risk, the concept of objective risk and a dual concept of risk. Based on the analysis of the concepts of risk the author distinguished the main characteristic features of the notion of «risk». Then, the author analyzes the notion of insurance risk as a central element of the insurance legal relationship. As a result, the author describes the characteristics of insurance risk depending on the type of insurance relationship, namely, signs of insurance risk in the contract of medical insurance.
