Determination Of Approaches To The Concept Of «Reason To Commit A Crime»

Abstract

In the article it is presented the determination of approaches to the concept «reason» in the context «to commit a crime» using analysis of different philosophical, criminological and criminal categories. The author presents her own position about determination of the reason to commit the crime.

Reason to commit the crime - it is the circumstances that in a particular life situation became an impetus for a person to commit socially dangerous acts.The specific life situation has a certain objective content and because of this there are circumstances that actually affect the person.

However, there is also a subjective sense - assessment of the situation, that entirely depends on the person and doesn't necessarily reflect his/her objective content.

Human behavior can't be considered in isolation from the situation. It should be considered that in some cases an offender himself intentionally creates the conditions for his/her actions, and in other cases, circumstances may significantly restrict the person's choice of one or another way of behavior.
