The Concept Of The Undue Advantage In The Criminal Law Characteristics Context Under The Art. 369-3 Of The Criminal Code Of Ukraine

Abstract

The article contains the statement that the phenomenon of corruption in modern sport is manifested in the manipulation of sports competitions in order to obtain the undue advantage. Thus, the matter of the content and essence of the concept of «undue advantage» within the meaning of Art. 369-3 of the Criminal Code of Ukraine and related legislation is being discussed. The author examines the required features of the concept of «undue advantage» and determines several approaches to solving the problem of the definition of undue advantage under the Art. 369-3 of the Criminal Code of Ukraine.
